01      The proposed development site is on the edge of the High Street where most patrons of the Café are likely to originate from walking to and from the site, however, the employees and future occupiers of the flats above will require off street parking facilities, it being unreasonable to assume they will not be necessary and where the proposal is likely to generate an off street car parking demand of between 4 and 7 vehicles due the flats being 3 bedrooms. The nearest car parking facility being at Victoria Place where there exists approximately 22 car parking spaces which are most likely to be in demand throughout the working day and weekends by shoppers and visitors to Brightlingsea.

 

It is further observed that the adjoining streets, Wellington Street and Nelson Street run between rows of Victorian villas and cottages with small or no frontages available for off street parking and where these occupiers rely on on-street parking for their vehicles.

 

The proposal fails to provide off road parking facilities in accord with current Parking Standards. The proposal would lead to additional vehicles being left parked in the adjoining highway and within Hall Cut causing conditions of congestion, danger and obstruction, contrary to the interests of highway safety.

 

The proposal is therefore contrary to the interests of highway safety, and contrary to Saved Policy TR7 of the Tendring District Local Plan (2007), Policy SD8 of the Tendring District Local Plan Proposed Submission Draft (2012), Essex County Council Parking Standards (2009), and Saved Policy QL10 (vi) of the Tendring District Local Plan (2007), and Draft Policy SD9 of the Tendring District Local Plan Proposed Submission Draft (2012) as amended by the Tendring District Local Plan: Pre-Submission Focussed Changes (2014), which requires new development to be designed to meet its functional needs.

 

02      The development includes the creation of 2 no. 3 bedroom flats of which require a minimum of 25 square metres per flat provided communally or a minimum balcony area of 5 square metres for units above ground floor level as set out within Saved Policy HG9 of the Tendring District Local Plan (2007).

 

Whilst it is recognised that the site is located within the centre of Brightlingsea being a short walk to many amenities including a beach and play park, the proposal fails to provide any private amenity space, outside storage or clothes drying areas. These issues are exacerbated by the fact that the flats are 3 bedrooms and will be occupied by families or a number of adults.

 

The development is therefore contrary to Saved Policy HG9 of the Tendring District Local Plan (2007) as it fails to provide any private amenity space for the occupants of the proposed flats.
