Minutes of the Council Meeting held at The Parish Hall, Victoria Place, Brightlingsea on: Thursday 21st February 2013 at 7.30 p.m.

178. TO APPROVE THE MINUTES OF THE MEETING HELD ON 17TH JANUARY 2013 AND CONFIRM AS A CORRECT RECORD:

The Minutes were accepted as a true record. 

179. TO APPROVE THE MINUTES OF THE EXTRA ORDINARY MEETING HELD ON 7TH FEBRUARY 2013 AND CONFIRM AS A CORRECT RECORD:

180. MAYOR’S ANNOUNCMENTS:

Copy of the Mayor’s Announcements is annexed to the Minutes.
  
The Mayor then mentioned the Chelmsford Cathedral service she attended on the 31st January to commemorate the anniversary of the 1953 floods. She said that this was a very good service, which was also very sad.  She attended with Mr Macgreggor who lived at Lea- over-sands at the time and rescued his family.

She also attended, with the Town Clerk, the Tourism and Leisure show today at the Crowne Plaza, Colchester Five Lakes, Maldon.

182. DECLARATION OF DISCLOSABLE PECUNIARY INTERESTS:

The Mayor reminded Members to declare interests when necessary.

183. TO RECEIVE AND APPROVE THE RECOMMENDATIONS OF THOSE MEMBERS EXAMINING THE ACCOUNTS FOR THE CURRENT PERIOD:

The Payments and Accounts for the period ending January 2013 as shown on the attached appendix) were proposed by Cllr Olivier as follows:

General Account Cheque No’s 705477 – 705500 in the sum of £15,897.84 for payment

Bank Balances – All Accounts – in the sum of £250,999.68
Employee payments paid for the month of January were £10,737.36

Seconded by Cllr Goggin.  Agreed.

184. COUNTY COUNCILLOR ROBINSON:

County Councillor Robinson congratulated the Council on receiving the £5,000.00 grant from the Big Society towards the repair of the Skate park. 

He then reported on the following:

• There will be funding available next year for Highways Issues, but you need to get in early, and ask your County Councillor to take the proposal forward.

• The PCT will terminate on the 31st March 2013, and the County Council will take over responsibility for public health.  Ann Naylor will be responsible for health.

The Mayor stated that the office had received an e-mail reply from Councillor Derrick Louis, concerning the water on the B1029 in Alresford, which she read out.  County Councillor Robinson said he had already taken this up with Alresford Parish Council, as it was in their area, not Brightlingsea.

Councillor Aldridge mentioned that a couple of residents in Mill Street wish to have the national speed limit lowered to 30 mph.  Apparently a lot of parents walk down there, and there is a problem with cars speeding.  She asked County Councillor Robinson if he could back this for them, and asked who do we approach?  County Councillor Robinson replied that you should get a petition up, and this would be something for the representative on the highway  panel to take forward.

Councillor Aldridge also mentioned the terrible state of the roads.  County Councillor Robinson said keep reporting the dangers.  Councillor Aldridge replied that some pot holes are being filled, but they are just as bad again within 6 weeks.  She suggested someone should have a word with the contractors.

Councillor Olivier asked County Councillor Robinson is he knew anything about the IPOS Mori questionnaire, which was sponsored by Essex County Council.  County Councillor Robinson replied that he had not heard of it.

185.  TO RECEIVE QUESTIONS FROM THE PUBLIC:

186. TO RECEIVE THE MINUTES OF THE PLANNING MEETINGS HELD ON 24 TH JANUARY 2013 AND TO NOTE PLANNING DECISIONS OF TENDRING DISTRICT COUNCIL:

Councillor Dixon proposed that the recommendations in the Minutes of 24th January 2013 be agreed by Council, together with the planning decisions from TDC.  Agreed. 

He then spoke about the application for the Old Gas Works and that they had taken the car parking issues seriously under items 9 and 19. 

187. TO RECEIVE REPORTS SUBMITTED FROM MEMBERS WITH SPECIAL  RESPONSIBILITIES:
Further to the written reports:- 

Councillor Aldridge – Received a lot of praise from the people using Clacton bus, this service is getting better and better.  She stated that Councillor Olivier will be giving a report about this service at the end of the year.  They are having a meeting tomorrow with Danny Douglas, to get copies of user figures etc.  Apparently there have been a couple of incidents  of Cedrics Bus drivers shouting at passengers to get on their bus.

Was invited to Chavasse VC House at Merville Barracks Colchester and the organiser is hoping to invite all councillors to visit in the near future.

Councillor Goggin reported that the 7 ‘O’ clock Hedingham bus last Monday week, broke down 15 times between Church Road and Thorrington.  The 7.30am Cedrics service turned up and the Hedingham driver asked if they would take his passengers and tickets – he said yes.

Councillor Yallop – Tracey and I attended the  Tourism Show at Five Lakes today, it was a very long day.  The show was busy, slightly down on last year, but the response we received has been very good.  She asked the Portfolio Holder for Tourism for Tendring, Councillor Goggin, why Tendring was not at the Tourism and Leisure Show?  Councillor Goggin said he did not know but would enquire and let her know the answer.  Councillor Yallop replied that she could not believe they were not there, and a few people also asked at the show why they were not there. 

Councillor Goggin mentioned a recent FOI request that had been received from a local resident.  He stated that as a Councillor you are not subject to the FOI Act.  He has however produced some 70 letters and e-mails, and nothing in there is connected with the residents name. 

188. TO RECEIVE REPORTS SUBMITTED FROM MEMBER REPRESENTATIVES ON OUTSIDE BODIES:
 
There was nothing to add to these reports. 

189. TO RECEIVE REPORTS SUBMITTED FROM DISTRICT COUNCILLORS:

Councillor Goggin – The second of the cabinet question and answer sessions took place at Harwich on Tuesday.  These are no agenda meetings.  With the two meetings that have taken place some 40-50 questions have been asked.  So far a 1/3 of questions have been nothing to do with Tendring District Council, but other local government services.

Councillor Steady asked Councillor Goggin for clarification on the budget meeting that took place at Tendring District council last week.  A discussion then took place.  Councillor Russell then moved next business.

The Mayor reminded members that Tendring District Council politics should not come into Parish Meetings.

190. TO RECEIVE THE TOWN CLERK’S REPORT: 
 
2.1 – It was agreed that the Music Festival could borrow the Councils Gazebo, at the agreed rate.

Councillor J Chapman mentioned item1.12 on the Clerks report and asked Councillor Olivier what the current situation is with the Brightlingsea Society.  He stated that the  Committee had approached the Mayor to mediate between members, but she quite rightly refused.  He made no further comment on the situation.

191. MOTION TO EXCLUDE THE PUBLIC IN ACCORDANCE WITH THE PUBLIC BODIES (ADMISSION TO MEETINGS) ACT 1960 – To discuss the following:
(a) To receive the Part B Minutes from the Council meeting held on 17th January 2013 and confirm as a correct record
(b) Music Festival Funding
(c) Review of Council Reserves
(d) Property/Leases Update
