Minutes of the Council Meeting held at The Parish Hall, Victoria Place, Brightlingsea on:
Thursday 18th June 2009 at 7.30 p.m.

The Mayor welcomed everyone to the meeting, and gave a special welcome to Councillor Peter Halliday from Tendring District Council.
16. APOLOGIES FOR ABSENCE: County Councillor Robinson
17. TO APPROVE THE MINUTES OF THE MEETING HELD ON 21ST MAY 2009 AND CONFIRM AS A CORRECT RECORD:
The Minutes were accepted as a true record.
18. MAYOR’S ANNOUNCMENTS:
A copy of the Mayor’s Announcements is annexed to the Minutes.
19. DECLARATION OF PERSONAL AND PREJUDICIAL INTERESTS:
The Mayor reminded Members to declare interests when necessary.
20. TO SIGN OFF THE END OF YEAR ACCOUNTS FOR 2008-2009, TOGETHER WITH THE ANNUAL RETURN AND ASSOCIATED DOCUMENTS:
Cllr Block proposed the end of year accounts in the new format, which had been agreed previously by both Finance Committee and Full Council. He mentioned that the only problem that could occur is that the opening balance may not be correct, as the external auditors had not signed of the previous three years accounts, due to a challenge by a resident. Seconded by Cllr Russell.
Members went through page 3 of the Annual Return and answered yes to questions 1-8, and n/a to question 9.
The accounts and associated documents were then signed off by the Mayor.
21. TO RECEIVE AND APPROVE THE RECOMMENDATIONS OF THOSE MEMBERS EXAMINING THE ACCOUNTS FOR THE CURRENT PERIOD:
Due to the year end and start of the financial year, it has not been possible to prepare the end of April and May 2009 Statement. This will be presented at the next Council Meeting.
Councillor Russell then proposed the following cheques which were drawn as follows:
General Account – Cheques Nos 704300 – 704343in the sum of £19,065.53
Seconded by Cllr Yallop. Agreed.
Members then asked who cheques were for, and the following replies were given.
Cllr Steady – 704337 – Simon Hook – Cllr Russell replied it was for work carried out on the Fountain
Cllr V Chapman – 704342 – Winzer Worth – Tracey Pulford replied it was for the Grounds staff bits and bobs
Cllr Beckwith – 704334 – Prettys – Tracey Pulford explained that this was for legal costs relating to the Brightlingsea Leisure Village, however we are re-charging this to Mr Hammerton. Cllr Block explained that if we incur costs due to the lease holder we can claim back from him.
22. COUNTY COUNCILLOR ROBINSON:
County Councillor Robinson was absent from the meeting and had give no report.
23. TO RECEIVE REPORT FROM TENDRING DISTRICT COUNCILLOR PETER HALLIDAY – PORTFOLIO HOLDER FOR FINANCE:
Tendring District Councillor Peter Halliday – Portfolio Holder for Finance gave a report on the current situation at Tendring with regard to Intend.
After much discussion the Mayor thanked Councillor Halliday for attending.
23. TO RECEIVE QUESTIONS FROM THE PUBLIC:

24. TO RECEIVE THE MINUTES OF THE PLANNING MEETINGS HELD ON 28TH MAY AND 11TH JUNE 2009 AND TO NOTE PLANNING DECISIONS OF TENDRING DISTRICT COUNCIL:
Councillor Dixon proposed that the recommendations in the Minutes of 28th May and 11the June 2009 be agreed by Council, together with the planning decisions from TDC. Agreed.
Cllr Goggin asked about the Harbour Moon. Cllr Holding explained that Tendring District Council had been informed about the Take-Away, but until they are actually selling, they cannot do anything about it.
25. TO RECEIVE REPORTS SUBMITTED FROM MEMBERS WITH SPECIAL RESPONSIBILITIES:
Further to the written reports:-
Cllr Aldridge – MSR for Highways and Transport – Someone with a horse and trap needs an area of land to practice. Cllr Holding said they should contact the local farmers to see if they have any land. Cllr J Chapman suggested they contact Steve Johnson of Johnsons Farm, Cllr Goggin suggested Martin Scott of Gate House Farm.
Cllr Beckwith – MSR for the Hard – Nothing further to report.
Cllr J Chapman – MSR for Welfare and Services for the Elderly -– Declare another gift received – working with a resident of the Company London and Quadrant Housing Company. The resident gave me some red roses and box of chocolates for all my help.
Cllr V Chapman – MSR for the Western Promenade – Dave the Seafront warden is now back in Clacton on a part time basis, after illness.
Have been speaking to Andrew Nepeen about the toilets on the Promenade. They were closed early (7.30pm) on the Thursday of the Fair.
The Ability whirl is much appreciated by the families with children in wheelchairs.
Still liaising with Damien Williams about the sheds in the Victoria Place car park.
Cllr Goggin – MSR for Regeneration and Web-Site – The web-site should be up and running in one month, and we will need your MSR input.
Have been working on a project for the Hoppa Bus. Essex County Council have received 30 bids but only 12 are going forward, and 3 or 4 will be accepted by Local Government.
Cllr Holding – MSR for Footpaths and Open Spaces – 99% of the footpaths in the town are now up and running.
There is a footpath that runs past John Partridges house and the seawall. As he is the owner of the footpath he is creating a style (to stop motorcycles using it).
There is a footpath running through a field of cattle, which is quite intimidating. Reported this to Essex county Council only to be informed that the owner does not have to put up a warning sign.
Cllr G Mann – MSR for the Swimming Pool – Nothing further to report.
Cllr Russell– MSR for Grants – Nothing further to report.
Cllr Steady – MSR for Allotments and Amenity Areas and Youth – Sent a letter to residents in Bellfield Avenue about the replacement of the fence around the Rec. Only received one positive response. We will now be looking at other ways of securing the area.
Lower Park Playing Fields – would like to do something different, trees, shrubs, adventure playground. There is a new piece of equipment ‘adizone’, and have been speaking to Kirsty and David Hall at Tendring about this.
Small grants scheme – if organisations are making improvements to property and it is our property being upgraded, why can’t we offer them a loan. Cllr Block suggested this is taken to a finance meeting.
Cllr Yallop – We have had a coach load of tourists visiting Brightlingsea. Will now get in touch with my contacts I met at the Tourism & Leisure Show, to get them to come down and give a report on Brightlingsea.
Cllr Dixon declared an interest on the following item.
Cllr Dixon mentioned that the churchyard situation was similar to 8 years ago. The new field is filling up quickly. The Mayor replied that we have written to Mr Scot who has no more land available. We are also making contact with Trinity College.
26. TO RECEIVE REPORTS SUBMITTED FROM MEMBER REPRESENTATIVES ON OUTSIDE BODIES:

27. TO RECEIVE REPORTS SUBMITTED FROM DISTRICT COUNCILLORS:
Cllr Goggin asked if there was any chance of changing the date of the September Council meeting from the 17th. This would be looked into.
Cllr Steady – The Town Council has been proactive in the last two years, in conjunction with Tendring District Council and others. Following a recent article in the paper, a councillor said they felt misled at the recent photo shoot. He explained that he had organised the photo shoot and if someone felt misled they should have told him. Cllr Goggin said sorry if his report had caused friction, but it was not only Cllr V Chapman that felt like this.
28. TO RECEIVE THE SECRETARY’S REPORT:
2.1 – If anyone wishes to attend please let the office know.
2.2 – Agreed the RNLI money box could be placed outside the Parish Hall for two week period.
2.3 – Agreed Brightlingsea Cricket Club – Cricket Week from Monday 27th July – 1st August, with a marquee on 29th, 30th and 31st July. Times agreed to be as last year. Also permission given to erect marquee on 29th September for end of season presentation evening.
2.4 – Agreed Music Festival can erect small gazebos on Hurst Green for Art Exhibition and Pimms Tent on 2nd August.
