Minutes of the Council Meeting held at The Parish Hall, Victoria Place, Brightlingsea on: Thursday 16th August 2012 at 7.30 p.m.

057. APOLOGIES FOR ABSENCE: None received.

058. TO APPROVE THE MINUTES OF THE MEETING HELD ON 19TH JULY 2012 AND CONFIRM AS A CORRECT RECORD:

The Minutes were accepted as a true record. 
 
059. MAYOR’S ANNOUNCMENTS:

Copy of the Mayor’s Announcements is annexed to the Minutes.

060. QUESTIONS UNDER SO 9(2):

None Received.

061. DECLARATION OF DISCLOSABLE PECUNIARY INTERESTS:

The Mayor reminded Members to declare interests when necessary.

062. TO RECEIVE AND APPROVE THE RECOMMENDATIONS OF THOSE MEMBERS EXAMINING THE ACCOUNTS FOR THE CURRENT PERIOD:

The Payments and Accounts for the period ending July 2012 (as shown on the attached appendix) were proposed by Cllr Goggin as follows:

General Account Cheque No’s 705329 – 705350 in the sum of £8821.15 for payment
Bank Balances – All Accounts – in the sum of £246,194.94
Employee payments paid for the month of July were £10,697.11

Seconded by Cllr Mann.  Agreed.

Councillor Goggin then briefed members on cheque numbers 705339 and 705350 which were both being recharged to others.

063. COUNTY COUNCILLOR ROBINSON:

County Councillor Robinson reported on the following:

• Footpath 25 – An officer has been down to inspect FP25, and has sent all the necessary information to Councillor Edey. 
• Received notification today of the Local Highway Panel.  The letter sets out the criteria for the panel.
• Potholes – Have chased Highways over the pothole in Winsor Court and been told that it has been looked at, assessed, and is now in the system of priority to be fixed.

Councillor Aldridge asked County Councillor Robinson about the bus stop opposite Quenby and that the hard standing is all overgrown and somebody fell over the other day.  County Councillor Robinson said he would have a look when passing.

Councillor Aldridge also asked a question on behalf of Mr Price – who will be the one Councillor from Essex County on the new Police and Crime Panel, and how will this person be chosen.  County Councillor Robinson replied that this person would be nominated by the Leader of the Council.

065. REPORT FROM THE BRIGHTLINGSEA RUGBY CLUB:

Jeff Dunn from the Brightlingsea Rugby Club thanked the Council for the opportunity to talk to members. He stated that they have two objectives, 1 is the longer term aspirations and the support given, and 2 the short term objective of staying on the Lower Park field.  Jeff then briefed members on the current situation and plans for the future.  A discussion took place and it was then agreed that the Finance Committee would meet to discuss this further.

The Mayor thanked Mr Dunn for attending the meeting.

066. JUBILEE – SURPLUS OF FUNDS:

The Mayor mentioned that at the last meeting it had been agreed that this item be deferred to this meeting in case any other Councillors had a project in mind for the surplus of jubilee funds. After discussion it was agreed that the Clock at the Hard would be looked at/refurbished. 

067. TO RECEIVE THE MINUTES OF THE PLANNING MEETINGS HELD ON 26TH JULY 9TH AUGUST 2012 AND TO NOTE PLANNING DECISIONS OF TENDRING DISTRICT COUNCIL:

Councillor Dixon proposed that the recommendations in the Minutes of 26th July and 9th August 2012 be agreed by Council, together with the planning decisions from TDC.  Seconded by Councillor Block.  Agreed. 

Councillor Dixon then mentioned the application for the old gas works  He stated that the site had now been sold.  Councillor Aldridge informed members that she will be delivering flyers to Sydney Street, Tower Street and Ophir Road to inform them of the application. 

068. TO RECEIVE REPORTS SUBMITTED FROM MEMBERS WITH SPECIAL RESPONSIBILITIES:
Further to the written reports:- 

Councillor V Chapman – Heard from Steve Gove of  TDC that the digger was on the beach today, clearing sand from footpath.  Regarding the camping vehicle on Promenade Way – apparently the PCSO asked them to move on.  Councillor Steady asked about the paths around the paddling pool and whether or not they are cleaned everyday.  Councillor Chapman replied no, the beach cleaner only carries out certain jobs daily. 

Councillor Edey briefed members on a picture of a kissing gate, as stated in her report.  She stated that something needs to be done to put hording over it, it is an expensive job but asked for Councils approval to spend her MSR budget money on this.  The Mayor stated that if it is in the budget, she should go ahead. 

Councillor Goggin informed members that the second annual waterside meeting is taking place on 13th September and he would welcome any councillors who are available. 

He reported on an incident of a man selling 2 cars in front of the Hard Shelter.  He stated that he is a resident on the Marina, and has a car parking space on Marina, however his Company Car is in that space. 

In the process of setting up a meeting with Essex County Council who install the no parking signs, plus the Essex North Partnership who police the yellow lines. 

Councillor V Chapman asked Councillor Goggin about the fish seller on the hard.  Councillor Goggin replied that he is on private land so there is nothing we can do.

Councillor Olivier spoke about the report produced by Councillor J Chapman, and about the number of complaints received.

Councillor Steady spoke about Warrens Pond and that they have landed a Sponsorship deal with Ponds UK, who are a National Company based in Brightlingsea.

069. TO RECEIVE REPORTS SUBMITTED FROM MEMBER REPRESENTATIVES ON
OUTSIDE BODIES:

Councillor V Chapman mentioned that at the last TDALC meeting the Chairman of the EALC also attended.

Jacobs Hall – Have spoke to Mr Neale from English Heritage, who will be visiting Brightlingsea in the near future to look at Jacobs Hall. 

070. TO RECEIVE REPORTS SUBMITTED FROM DISTRICT COUNCILLORS:
Further to the written reports:- 

Councillor Olivier mentioned the Local Tax Survey which TDC are carrying out, and asked what impact this would have on the precept.  Councillor J Chapman replied that the figures will not be known until October. 

Councillor Goggin mentioned the Pride of Tendring Awards and that Brightlingsea is the only Town that used up its allocation of three nominations.  Councillors will shortly be asked for this years nominations. 

071. TO RECEIVE THE TOWN CLERK’S REPORT: 

2.1 – Agreed The Dogathon can use the Western Promenade for its sponsored dog walk and fun dog show on 3rd March 2013.  Also Town Council to help promote the problems of dog mess etc at the event. 
2.2 – Agreed  The Scouts can use Lower Park Playing Field for its Classic Car Show and Fun Day on Sunday 2nd September 2012.
2.3 – Model Boat Club to be asked for a copy of their insurance documents for their forthcoming Table Top Sale. 

072. MOTION TO EXCLUDE THE PUBLIC IN ACCORDANCE WITH THE PUBLIC BODIES (ADMISSION TO MEETINGS) ACT 1960 – To discuss the following:
(a) To approve the Part B Minutes from the Council meeting held on the 19th July  2012 and confirm as a correct record.
